By purchasing or using any digital products from this website, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions:
“Peoples Perspective” (also referred to as “we”, “us”, or “our”) means Jessica Fletcher (née Peoples), trading as Peoples Perspective Australia (ABN 71 370 944 207).
“Conversation Kits” means the digital conversation guides, templates, frameworks, worksheets, and related resources sold under the Conversation Kits™ brand by Peoples Perspective.
“Digital Products” means all Conversation Kits and any other digital resources, guides, templates, or materials sold or provided by Peoples Perspective.
“Organisation” means the legal entity (company, partnership, sole trader, government body, or other organisation) that purchases a Conversation Kit or Digital Product. For the purposes of these terms, “your organisation” includes your employees (permanent, part-time, and casual), your contractors and temporary workers engaged to perform work for your organisation, and your directly controlled subsidiaries (entities where you own more than 50% of voting rights).
“Your organisation” does not include independent consultants or agencies you engage to deliver services to external clients, related entities where you do not have majority control, joint venture partners or alliance organisations, or your clients, customers, or external stakeholders.
“Internal Use” means use of the Digital Products within your organisation for your own operational purposes, including internal training, leadership development, team conversations, and organisational capability building.
“External Use” means any use of Digital Products outside your organisation, including resale, sublicensing, incorporation into paid or free programs delivered to external clients, distribution to partner organisations, or making materials available to third parties for independent use.
“Licence” means the limited, non-exclusive, non-transferable right to use Digital Products in accordance with these Terms and Conditions.
2. Overview
These Terms and Conditions apply to all digital products sold by Peoples Perspective under the Conversation Kits™ brand. By purchasing or accessing any Digital Product, you agree to these Terms, our Refund Policy, and our Privacy Policy. If you do not agree, you must not purchase or use our products.
3. Product description and delivery
Conversation Kits are digital, editable resources designed to support better leadership and culture conversations. Each product page sets out what is included. Unless otherwise stated, products are delivered digitally via download links or access emails after payment, no physical products are supplied, and you are responsible for ensuring you have the required software or accounts to use the product. Please review product descriptions carefully and contact us with questions before purchasing. Personal information is handled in accordance with our Privacy Policy.
Access links may be updated
From time to time, we may update or replace the access link(s) provided for DIGITAL PRODUCTS (including Canva template links) to maintain access, functionality, or file integrity, or where required due to third‑party platform changes. Where this occurs, we will take reasonable steps to notify purchasers and provide an updated link or alternative access method.
4. Licence we grant you (internal use only)
When you purchase a Digital Product, we grant you a non-exclusive, non-transferable, limited Licence to use it within your organisation only. This allows you to use and adapt the content for internal workshops, conversations, and training; share materials internally with leaders, employees, and contractors as defined above; apply your own branding and light wording edits; and upload materials into internal enterprise AI tools solely for internal use, provided the content is not used to train AI models or redistributed externally.
You are responsible for controlling access, ensuring internal systems are not accessible to external parties, preventing unauthorised distribution, and any breach arising from poor internal controls.
5. Prohibited use
You must not resell, sublicense, or redistribute Digital Products; use them in programs or offerings delivered to external clients without written permission; share editable files with external parties; upload materials to public platforms or shared drives accessible externally; or remove copyright, branding, or attribution notices.
6. Intellectual property
All Conversation Kits and related materials are the intellectual property of Peoples Perspective unless stated otherwise. Purchasing a product grants a Licence only, not ownership. “Conversation Kits™” is our trade mark. You must not represent yourself as Peoples Perspective or imply endorsement without permission.
Licences may not be assigned or transferred without written consent. In the event of a sale, merger, or restructure, Licences do not automatically transfer and must be renegotiated.
7. Disclaimers and limitation of liability
Conversation Kits are professional development tools only and are not a substitute for professional advice. We do not guarantee outcomes or compliance. You are responsible for ensuring use complies with applicable laws and organisational obligations. To the extent permitted by law, our liability is limited to resupplying the product or refunding the purchase price. Nothing in these terms limits your rights under the Australian Consumer Law.
Australian Consumer Law Notice: Our services come with guarantees that cannot be excluded. For major failures, you may cancel the service and receive a refund or compensation. For minor failures, you are entitled to have the issue rectified within a reasonable time.
8. Refunds
Digital Products are delivered instantly and generally non-refundable for change of mind once accessed. We honour all rights under the Australian Consumer Law. Remedies may be available where there is a technical access issue caused by us or a major fault or misdescription. Full details are set out in our Refund Policy.
9. Suspension, termination, and misuse
If we reasonably believe these terms have been breached, we may suspend access, cancel products, decline future sales, or take legal action. Key clauses relating to intellectual property, licence restrictions, prohibited use, and liability survive termination.
10. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including platform outages, internet failures, natural disasters, or cyber incidents. We will use reasonable efforts to restore access.
11. Entire agreement
These Terms, together with our Refund Policy and Privacy Policy, form the entire agreement between you and Peoples Perspective and override prior communications. If there is any inconsistency, these Terms prevail.
12. Governing law
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of those courts, with our right to seek urgent relief elsewhere preserved.
